In the latest round of hurling insulting comments on each other of Apple vs. Amazon “App Store” — Apple’s latest cour filing embedded below has harsh words for Amazon’s ppstore for Android — saying it’s “inferior” and will “tarnish” Apple’s image.
Amazon launched their Appstore for Android in March this year.
Following the launch, Apple sued Amazon.com citing “App Store” trademark infringement in March this year.
In its court filing, Apple says that through Amazon’s app store, “Amazon is making software available that bypasses security safeguards on Android, thereby increasing the potential harm of viruses and malware to customers’ Android devices.”
Apple says Amazon chose to use the app name “to trade on the fame and goodwill established by Apple.”
Apple seeks to defend against Amazon’s assertion that the name “app” is generic.
Meanwhile in a separate proceeding, Microsoft, HTC, Nokia and Sony Ericsson are challenging Apple’s claim to the “app” name.
